Terms of Service & Operational Governance

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Signalzappyd Expedition Systems Ltd. (Registration No. HRB-849201-E, registered at 14 Quai du Port, 06300 Nice, France, hereinafter "Signalzappyd", "we", "us", or "our"). By accessing or using the website at signalzappyd.yachts, our route building calculators, geographic itineraries, or associated logistics datasets, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. Scope of Route Architecture & Information Services

Signalzappyd provides curated European route guides, topographic waypoints, elevation datasets, transit timing estimates, and interactive itinerary synthesis software. The content is engineered for planning, informational, and educational travel design purposes. While we routinely calibrate timetables and road profiles with regional transit authorities (such as SBB, RhB, CFR, and Anas), real-world travel conditions remain subject to independent variables.

3. Mountain Passes, Road Closures & Transit Feasibility

Users acknowledge that high-altitude overland corridors (including the Swiss Oberalp and Bernina passes, Romanian Transfăgărășan DN7C, and Italian coastal corniche roads) are subject to seasonal closures, extreme weather phenomena, geopolitical regulations, and maintenance detours. Signalzappyd does not warrant that any scenic pass or rail segment will be unobstructed during your specific travel dates. You are strictly responsible for checking real-time road conditions and railway operator advisories prior to departure.

4. Intellectual Property Rights & Route Licensing

All proprietary algorithms, interactive route builders, vector cartography, written dossiers, night allocation formulas, graphics, photographs, and source code displayed on Signalzappyd are the exclusive property of Signalzappyd Expedition Systems Ltd. or its licensors and are protected under international copyright, trademark, and database protection laws.

  • You are granted a revocable, non-exclusive, non-transferable personal license to view, save, and print itinerary guides for individual, non-commercial travel planning.
  • You may not reproduce, reverse-engineer, distribute, sell, or scrape our route topology datasets or calculator algorithms for commercial deployment without written authorization from our Nice Expedition Desk.

5. User Obligations & Permissible Use

When utilizing our communication portals, route explorer engines, or data forms, you agree not to:

  • Deploy automated bots, spiders, or data scrapers to extract route geometries or logistical data.
  • Submit falsified contact information or transmit harmful payloads, malware, or spam through our Expedition Desk forms.
  • Use our route blueprints in violation of local motoring regulations, road safety statutes, or alpine park conservation laws.

6. Limitation of Liability

To the maximum extent permitted under applicable law, Signalzappyd Expedition Systems Ltd., its directors, employees, and field scouts shall not be liable for any indirect, incidental, punitive, consequential, or exemplary damages arising from: (a) delays, missed connections, or schedule alterations by rail, ferry, or road carriers; (b) vehicular damage or accidents incurred during transit; (c) changes in pass access fees, road toll policies (such as Rovinieta or Swiss vignettes); or (d) reliance on estimated driving hours and waypoint intervals.

7. Third-Party Links & Transit Providers

Our dossiers reference external transport carriers, booking platforms, and government agencies. These external links are provided solely as a logistical convenience. Signalzappyd exercises no editorial or operational control over third-party websites, their ticketing policies, or privacy practices.

8. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the French Republic, without regard to conflict of law principles. Any legal dispute, controversy, or claim arising under or related to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Nice, France.

9. Modifications to Terms & Contact Desk
